Post Goosen on the "run" from Racing
Quote:
Racing 92 regrets to announce that Johan Goosen has not appeared at the club for the last two days and seems to have vacated his residence at Le Plessis-Robinson. As far as Racing 92 is concerned, Johan Goosen still remains bound to the club by an employment contract lasting four years, while his residence, company car, locker, and place in the locker-room all remain at his disposal. To this effect, Johan Goosen remains on the list of players qualified by the EPCR to play in the Champions Cup, starting with the match between Racing 92 and Munster this Saturday.

In response to Johan Goosen’s behaviour, Racing 92 is forced to initiate several legal proceedings aimed at enforcing its rights and redressing the harm done to the club. Racing 92 believes that the club is a victim of blatant fraud which Johan Goosen, his associates and various advisers must answer for in court.

Various civil proceedings will be taken out, partly to obtain reimbursement of the advance payments made to Johan Goosen with regard to his image rights, and also to obtain compensation for the non-provision of services to which he had committed in this domain.

A complaint will also be laid with the French Industrial Tribunal in order to prosecute the player’s fraudulent and wrongful failure to fulfil his contractual obligations and to compensate the resulting significant damage for the club.

A criminal complaint will also be filed, as the open-ended employment contract produced by Johan Goosen and signed by one of his friends and business associates appears to constitute a phony document, given that it is not conceivable that a player put an end to his sporting career while at the peak of such career, and accept a position in a South African company for a salary ten times less than what he was earning as a rugby player at Racing 92.

Full light must be shed on the responsibility of the various people who advised Johan Goosen in taking this aberrant and fraudulent strategy, and to this extent, there are grounds for wondering how Johan Goosen is being supported financially given the numerous commitments and investments he has to meet.

It's been ongoing for some time.
Goosen came back from 4 Nations with an SA offer in his pocket.
Problem was he's under contract but he played funny buggers and alienated himself between Boss and Coaches and Team.

There's another side issue when he joined Racing Lorenzetti gave Goosen's parents a 400k loan to buy a farm (could've been a salcap sidestep ;) ;) ) Now that's up in the air too.

This isn't without precedence Toulouse took international prop Califano who went to NZ to play whilst under contract to court and he was fined a very significant amount 150,000 euros

Alfie escaped similar by an off the record Cardiff / Tlse agreement after he left for a funeral, never returned and he and his agent had forgotten that Tlse had an additional 1 yr option! Despite Tlse call he pleaded injury but trained with the Welsh squad and went on tour with them. Then end of Season he signed for Cardiff. It was a dirty business.

Same happened when another Welsh centre/wing player Dafydd X(name escapes me) who had agreed to sign for Aix-en-Provence and was training with them when he had a call that is son was ill and he never returned having signed for Cardiff

The Goosen affair has been rumbling with other interference too involving other Clubs....

Why does it only happen in France?

Nah, that's never going to happen. Everyone knows the salary cap is tightly regulated in both England & France. There's no way any of the big clubs would bend the rules. ;) :D

as staed this issue on the go for more than 2 weeks now.

Goosen was voted Top14 player of the year last season.

He's 24 and returned from SA and told Racing he'd done a Rosberg and retired from rugby @ 24!
In reality he had been offered a job with a SA Co ...details not given.

Current proposed amount claimed for contract by Racing 1m euros.

I don't know about the SA company link, but it was reported before that Gloucester were the team trying to sign him after his "retirement" from Racing ... http://www.sport24.co.za/Rugby/Springbo ... r-20161220

Theat was refuted by Alrad the owner in waiting @ Gloucs and the owner of Montpelier which was also the rumour.
Altrad denied it publicly on Dec 13 but you never know

Given that you seem to research the french items extensively I'll leave you to translate the article
and note the comments and the opinion ref the Racing/Lorenzetti predicament.

Has he been sighted in any car park yet?

Best
